Commercial disputes and arbitration

Business and contract disputes before the Commercial Courts and arbitral tribunals, and court proceedings connected with arbitration.

Commercial Courts

Disputes arising from business contracts, supply and service agreements, partnerships, franchises and similar transactions are commercial disputes under the Commercial Courts Act, 2015 when their value is Rs 3 lakh or more. Unless urgent interim relief is sought, Section 12A requires pre-institution mediation before the suit is filed. Commercial suits run to strict timelines, so preparation before filing matters.

Arbitration

Where the contract has an arbitration clause, the dispute goes to arbitration under the Arbitration and Conciliation Act, 1996. I act in:

  • Interim relief from the court under Section 9, before or during arbitration
  • Appointment of an arbitrator by the High Court under Section 11 when the other side does not cooperate
  • Conduct of the arbitration: statement of claim, defence, evidence and arguments
  • Challenges to arbitral awards under Section 34 and their enforcement

Contract disputes generally

  • Recovery of unpaid invoices and dues
  • Breach of contract and damages
  • Disputes between partners, directors and shareholders of small companies
  • Disputes over tenders and government contracts
